1. Who this is between

Colony Battle Arena ("the Game") is provided by Gerbert Guliyev, Scheibengasse 17, 1190 Vienna, Austria ("we") — full details in the Impressum. By installing or playing the Game you agree to these terms. If you do not agree, do not use the Game.

On Apple platforms, Apple's Licensed Application End User License Agreement also applies. Where it conflicts with these terms, the stricter protection for you applies.

2. Your licence

We grant you a personal, non-exclusive, non-transferable licence to install and play the Game on devices you own or control, for your own entertainment. You may not sell, rent, reverse-engineer or modify the Game, run it with unauthorised software, or use it to build a competing product.

3. Your account

• The Game creates an account automatically so you can play without signing up. Signing in with Game Center links that account to you, so it survives a reinstall or a new device.
• You are responsible for what happens under your account.
• An account may occupy only one seat in a match at a time.
• You can delete your account at any time in Options → Account. Deleting it forfeits any unspent tokens and any remaining pass.

4. Tokens, the pass and purchases

• Tokens are a limited licence to use a feature of the Game. They are not money, have no cash value, cannot be exchanged for money or transferred between accounts, and cannot be sold or traded outside the Game.
• New accounts receive a starting grant of tokens. Tokens can also be earned by watching a rewarded ad or bought through the App Store.
• The pass is a one-off, non-renewing purchase that lasts for its stated period. It does not renew automatically and nothing is charged again when it ends.
• Purchases are processed by Apple, not by us. Refunds are handled by Apple under its own terms; we cannot issue them. If you are in the EU, your statutory rights are unaffected.
• If a purchase is refunded or reversed, the tokens or the pass it paid for may be removed from the account.
• Purchases made while playing as a guest can be moved to a signed-in account with Restore purchases in the store. They can be claimed once.

5. How to behave in multiplayer

The Game has no chat, but names are visible to other players and matches are played against real people. You must not:

• cheat, use unauthorised third-party software, exploit bugs or interfere with the simulation;
• choose an offensive, hateful, obscene or impersonating display name;
• deliberately feed, throw or fix matches, or arrange results with other players;
• sit idle in ranked matches, or leave them repeatedly to avoid a loss;
• attack, overload or probe our servers, or automate play.

Any player can be reported from the lobby or the in-game menu. We may review match records, rename an account, reset a rating, remove tokens obtained through cheating, or suspend or terminate an account that breaks these rules. Serious or repeated breaches may end the agreement without notice.

6. Availability

Online play, rankings and purchases depend on our servers and on services operated by Apple and Google. We may change, suspend or discontinue parts of the Game, and we may take servers down for maintenance. We do not promise uninterrupted availability, and we may end the online service altogether with reasonable notice.

7. Your content

The only content you supply is your display name and the reports you submit. You grant us the right to show your display name to other players and to store and act on your reports.

8. Our content

The Game, its artwork, sound, text and code belong to us or our licensors and are protected by copyright. Nothing in these terms transfers ownership to you.

9. Liability

The Game is provided as it is. To the extent the law allows, we are not liable for indirect or consequential loss, for lost tokens or progress caused by circumstances outside our control, or for the services of Apple or Google. Nothing here limits liability for intent, gross negligence, personal injury, or anything else that cannot be limited by law. Statutory consumer rights are unaffected.

10. Changes to these terms

We may update these terms. The current version is always on this page, and material changes will be announced in the Game before they take effect.

11. Law and jurisdiction

These terms are governed by Austrian law, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this choice does not deprive you of the protection of the mandatory law of the country you live in, and you may bring proceedings in the courts there. For everyone else, the courts competent for Vienna, Austria, have jurisdiction.

We are not obliged, and are not willing, to take part in dispute-resolution proceedings before a consumer arbitration board. Purchases are made through Apple's App Store; refunds are handled by Apple.
